Terms of Service

The agreement between you and KerbAlert when you use the app or this website. Please read it. The parts about safety and emergencies matter most.

About these terms

KerbAlert is run by KitCode Studios. KitCode Studios Ltd, registered in England and Wales with company number 17517161, is at Office 9944, 321-323 High Road, Chadwell Heath, Essex RM6 6AX. “We” and “us” means KitCode Studios. “You” means the person using KerbAlert.

By creating an account you agree to these terms, our Community Guidelines and our Privacy Policy, which explains how we use your information.

You must be 18 or over and live in the UK to use KerbAlert.

KerbAlert isn’t an emergency service

If someone is in danger or a crime is happening, call 999. For anything else the police need to know, call 101. Don’t rely on KerbAlert to get help.

Alerts depend on other people noticing and reporting, on your phone’s signal and settings, and on services like push notifications that we don’t control. We can’t promise that something will be reported, that a report is accurate, or that an alert will reach you in time.

Never put yourself at risk. Don’t confront anyone, don’t step in, and don’t use the app while driving.

Your account

  • Give us accurate details and keep them up to date. Only add cars you own or regularly use.
  • Keep access to your email and phone secure, because that’s how you sign in.
  • One account per person. Don’t share your account or use someone else’s.
  • Tell us straight away at support@kerbalert.co.uk if you think someone else has used your account.

Reporting

Reports only work if people can trust them. When you make a report you promise that:

  • you saw what you’re reporting, at the time and place you’re reporting it;
  • the photo is one you took there and then in the app;
  • you’re not reporting something to harass, embarrass or get back at anyone.

The Community Guidelines explain what’s allowed in more detail. False or malicious reports lower your trust score and can get your account suspended or closed.

Your content

You own the reports, photos, notes and descriptions you post. You give us permission to store, show, blur, resize and share them in KerbAlert, as described in our Privacy Policy, for as long as they’re on the service. Reports are deleted automatically after 90 days.

You’re responsible for what you post. Don’t post anything unlawful, or anything you don’t have the right to share.

Watch my car

People who offer to watch a car are volunteers. They’re not security guards and they’re not responsible for what happens to your car. Watching means keeping an eye out and letting the owner know, nothing more. Nobody should touch another member’s car or get involved in anything happening to it.

Moderation

Members can flag reports, and a report is hidden automatically once three different members flag it, while it’s reviewed. We can remove any content, and suspend or close any account, that breaks these terms or the Community Guidelines, or that puts people at risk. Where we can, we’ll tell you why. If you think we got it wrong, email us and a person will look again.

Guardian

Guardian is an optional paid subscription that isn’t available yet. When it launches:

  • You’ll buy it through the App Store or Google Play, and their terms will apply to payment, renewal and refunds. It renews automatically until you cancel.
  • You can cancel at any time in your App Store or Google Play subscription settings. Cancelling stops the next renewal; you keep Guardian until the end of the period you’ve paid for.
  • Calls and texts depend on mobile networks, and we can’t promise every one will get through.
  • The price and what’s included will be shown clearly before you buy.

KerbAlert shows occasional sponsored posts from businesses, and links out to other services such as parking apps. Anything we’re paid for is labelled “Sponsored”. We don’t endorse these businesses, we don’t take parking payments ourselves, and anything you buy or pay for through them is between you and the business.

Our responsibility to you

We’ll provide KerbAlert with reasonable care and skill, and we work hard to keep it running. But because it depends on other people and on services outside our control:

  • We’re not responsible for what other members post, or for what happens to your car, including towing charges, fines, theft or damage.
  • We’re not responsible for losses caused by an alert that was late, wrong or never arrived.
  • We’re not responsible for losses we couldn’t reasonably have foreseen, or for business losses.

Nothing in these terms limits our responsibility for death or personal injury caused by our negligence, for fraud, or for anything else the law doesn’t allow us to limit. Nothing in these terms affects your legal rights as a consumer.

Ending your account

You can delete your account at any time. See Delete your account for how, and what happens to your information. We can suspend or close accounts as described under Moderation, or if we stop running KerbAlert, in which case we’ll give you reasonable notice.

Changes and the law

We may update these terms as KerbAlert changes. If a change matters, we’ll tell you in the app before it takes effect. If you don’t agree, you can delete your account.

These terms are governed by the law of England and Wales. If you live in Scotland or Northern Ireland, you can also bring a claim in your local courts.
